WAIVERS OF INADMISSABILITY

An alien who is adjusting his status to legal permanent residence or who is applying for an immigrant visa must show that he is not inadmissible under any of the grounds stated under the Immigration and Nationality Act (INA). Some grounds for inadmissibility may include:

- illegal entry (or attempt at illegal entry) into the U.S.

- use of false documents to enter the U.S.

- accrual of unlawful presence, including staying beyond the time of a legally issued but expired visa, in the U.S.

- conviction for certain crimes

Not all grounds for inadmissability can be waived, and a waiver applies on a case-by-case basis. A waiver application may be granted upon the discretion of the USCIS if the alien is able to show, among other things, extreme hardship on his qualifying relatives.
